The Tribes are currently working to quantify their federally reserved water rights. In 2015 the Montana Legislature ratified the CSKT Water Compact (MCA 85-20- 1901). The Tribes are currently working with the U.S. Congress to introduce and ratify similar legislation. Many of the CSKT Water Compact’s carefully negotiated terms provide for additional protections for Tribal water resources. While climate change is not called out within the Water Compact, the Compact calls for adaptive management that will allow instream flow and irrigation project allocations to be adjusted in real time in response to climatic and hydrologic conditions.
